Board of Zoning Appeals

The Board of Zoning Appeals (BZA) was established pursuant to the provisions of Chapter 2-102 of the Walden Municipal Code. The BZA comprises five (5) members appointed by the Board of Mayor and Aldermen for staggered terms of five years. The Chairman of the BZA shall call meetings at such times and places within the Town as the Board of Appeals may determine.

The purpose of the BZA is to hear appeals in matters related to zoning ordinances. The BZA's powers, duties, and procedures are set forth in broad terms in Article 9 of the Walden Zoning Ordinance. 

The Board of Appeals shall have the power to grant variances and adjustments in the area and building site regulations of this Ordinance in cases where strict application of the regulations would result in practical difficulty or unnecessary hardship which is not attributable to the actions of the applicant or predecessors in title; but only in harmony with the spirit and intent of this Ordinance and in such a manner as to grant relief without substantial injury to the public interest and rights.

Additionally, The Board of Appeals may order the issuance of Temporary Permits for nonconforming uses or for uses incidental to the development of the area. [Walden Zoning Ordinance Article 9.03]
